Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the IT asset disposition, data destruction, and related services ("Services") provided by TwinPine Digital trading as TwinPine ITAD ("we", "us", "our").
By using our Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other organisation, you represent that you have the authority to bind that entity.
2. Services
We provide the following services:
- Data Destruction: Physical destruction of data-bearing media
- Data Sanitisation: Secure erasure of data in accordance with NIST 800-88 standards
- Asset Recovery: Assessment and remarketing of IT equipment with residual value
- WEEE Recycling: Environmentally responsible disposal of electronic waste
- Collection Services: Secure collection of IT assets from your premises
3. Quotes and Pricing
All quotes are valid for the period specified on the quote document. Prices are quoted in GBP and are exclusive of VAT unless otherwise stated.
Our quotes may include:
- Service charges: Fees payable by you for data destruction, collection, and related services
- Purchase offers: Amounts we will pay you for equipment with residual resale value
The net total represents the balance between service charges and purchase offers. This may result in either party owing payment to the other.
4. Customer Obligations
You agree to:
- Provide accurate information about the IT assets to be processed
- Ensure you have the legal right to dispose of all equipment submitted to us
- Remove any data you wish to retain before equipment is collected (we accept no liability for data loss)
- Provide safe access for collection of equipment where applicable
- Pay all invoices within the agreed payment terms
5. Data Destruction
We perform data destruction and sanitisation in accordance with NIST 800-88 Rev. 1 guidelines. Upon completion, we will provide a Certificate of Data Destruction detailing:
- Asset serial numbers and identifiers
- Method of destruction or sanitisation used
- Date of processing
- Confirmation of compliance with applicable standards
Important: While we take all reasonable precautions, no data destruction method can guarantee 100% irrecoverability. Our certificates confirm that industry-standard processes have been applied.
6. Transfer of Ownership
Ownership of equipment transfers to TwinPine Digital upon collection, unless otherwise agreed in writing. From this point, we assume responsibility for secure handling, processing, and disposal of the equipment.
For equipment we are purchasing from you, payment will be made within 30 days of processing completion, unless otherwise agreed.
7. Customer Portal
Access to our customer portal is provided on an invite-only basis. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use
We reserve the right to suspend or terminate portal access if we suspect misuse or breach of these Terms.
8. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim arising from these Terms shall not exceed the total fees paid by you for the relevant Services
- We shall not be liable for any indirect, incidental, special, or consequential damages
- We shall not be liable for any loss of data, revenue, profits, or business opportunities
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
9. Confidentiality
We will treat all information about your IT assets and business operations as confidential. We will not disclose such information to third parties except:
- Where required by law or regulatory authorities
- To our employees and contractors who need access to perform the Services
- With your prior written consent
10. Regulatory Compliance
We operate in accordance with applicable UK regulations, including:
- UK General Data Protection Regulation (UK GDPR)
- Data Protection Act 2018
- Waste Electrical and Electronic Equipment (WEEE) Regulations
- Environmental Protection Act 1990
We maintain appropriate registrations and authorisations required for our operations. Details of our current regulatory status are available on request.
11. Termination
Either party may terminate an ongoing service agreement by providing 30 days' written notice. Termination does not affect any rights or obligations that have accrued prior to termination.
Upon termination, you must pay for all Services performed up to the termination date.
12. Force Majeure
Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from circumstances beyond their reasonable control, including but not limited to natural disasters, acts of government, pandemic, or civil unrest.
13. Changes to Terms
We may update these Terms from time to time. Continued use of our Services after any changes constitutes acceptance of the new Terms. We will notify customers of material changes.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
